1. Introduction

PeakTraining AI ("Peak Training", "we", "our", or "us") is committed to protecting your privacy and the privacy of the young athletes who use our platform. This Privacy Policy explains what information we collect, how we use it, when we share it, and the rights you have over it. It applies to the PeakTraining AI website, mobile applications, and related services (collectively, the "Service").

By using the Service, you agree to the practices described in this Policy. If you do not agree, please do not use the Service.

2. Information We Collect

We collect the following categories of information:

  • Account information: name, email address, phone number, date of birth, and (for athletes under 13) verified parent or guardian contact information.
  • Athletic performance data: workout details, session metrics, progress history, and coach or parent annotations.
  • Health information you provide: height, weight, body metrics, and other data you enter into training logs. We do not access health data from third-party fitness trackers unless you explicitly connect them.
  • Video content you upload: training and skill videos you submit for AI analysis.
  • Device and usage information: IP address, browser type, operating system, device identifiers, crash logs, and aggregated usage patterns.
  • Location data: only with your explicit permission, and only used to provide location-based features you request.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Service;
  • Generate personalized training plans, AI coaching feedback, and performance insights;
  • Analyze athletic performance and detect safety issues in uploaded video;
  • Communicate with you about your account, service updates, and (with your consent) new features;
  • Enforce our Terms of Use, prevent fraud and abuse, and keep the platform safe for young athletes;
  • Comply with legal obligations and respond to lawful requests.

We do not sell your personal information, and we do not use children's data for behavioral advertising.

4. AI and Automated Decision-Making

The Service uses artificial intelligence to analyze video, generate training plans, and surface performance insights. We want you to understand how this works:

  • Video analysis: Uploaded videos are processed by TwelveLabs, a third-party video understanding provider, to detect safety issues and extract athletic signals. Per our data processing agreement, TwelveLabs may use analysis signals to improve its safety detection models; it does not receive your account information or use your raw video to train general-purpose models.
  • Coaching recommendations: Training plans and feedback are AI-generated and intended as suggestions, not professional medical or coaching advice. A human is always in the loop on consequential decisions, and parents and coaches can override any AI recommendation.
  • Your right to opt out: You can opt out of AI-generated recommendations in your account settings at any time. Opting out may limit the functionality of the Service.

5. Data Storage, Security, and Retention

We host data in the United States using providers that offer industry-standard encryption in transit and at rest, access controls, and regular security reviews. No system is 100% secure, but we continuously work to protect your information.

We retain information only as long as needed for the purposes described in this Policy or as required by law:

  • Video analysis data: 90 days, then permanently deleted.
  • Original video uploads: retained per your account settings; you can delete individual uploads at any time.
  • Account data: retained until you delete your account, plus up to 30 days for backup and recovery.
  • Legal or safety records: retained as long as required by applicable law.

6. Sharing Your Information

We do not sell or rent your personal data, and we do not share it with third parties for their own marketing or advertising purposes. We share information only as follows:

  • Service providers: cloud hosting, analytics, error monitoring, customer support, and video analysis (including TwelveLabs), bound by contractual data protection obligations.
  • Within the platform: with coaches, teammates, parents, or guardians you have granted access to, subject to parental control settings.
  • Legal and safety: when required by law, subpoena, or court order; or when we believe in good faith that disclosure is necessary to protect the safety of a child or the integrity of the Service.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, with notice to you and continued protection consistent with this Policy.

7. Your Privacy Rights

Depending on where you live, you may have the following rights over your personal information:

  • Access: request a copy of the personal information we hold about you;
  • Correction: ask us to fix inaccurate or incomplete information;
  • Deletion: request deletion of your account and associated data;
  • Portability: receive your data in a structured, machine-readable format;
  • Objection and restriction: object to or restrict certain processing;
  • Opt out of targeted advertising, profiling, or sale: we do not engage in any of these, but you have the right to confirm that in writing;
  • Non-discrimination: we will not discriminate against you for exercising any of these rights;
  • Appeal: if we deny your request, you may appeal by replying to our decision email.

To exercise any of these rights, email privacy@peaktraining.ai or use the tools in Account Settings. We will verify your identity before acting on a request and respond within the time frames required by applicable law.

8. Children's Privacy (COPPA)

Peak Training is designed with young athletes in mind, and we take children's privacy seriously. We comply with the U.S. Children's Online Privacy Protection Act ("COPPA"), including the 2025 FTC amendments.

  • Under 13: we collect personal information from a child under 13 only with their parent or guardian's permission, indicated through our parent-managed account flow. Parents and guardians control privacy settings, can review the child's data, and can request deletion at any time. We are actively expanding our parental-consent verification process to fully meet the 2025 amended COPPA Rule's requirements; please contact privacy@peaktraining.ai with any questions.
  • Data minimization: for users under 13, we collect only the information reasonably necessary to provide the Service, and we do not use it for behavioral advertising, profile building, or training third-party general-purpose AI models.
  • Limited use of persistent identifiers: we use Google Analytics to understand aggregate Service usage. We do not use children's data for behavioral advertising, profile-building, or cross-context targeted advertising. We are reviewing our analytics configuration in light of the 2025 amended COPPA Rule's narrowed internal-operations exception.
  • Parental rights: parents can contact privacy@peaktraining.ai to review, delete, or stop further collection of their child's information.

If we learn we have collected personal information from a child under 13 without verifiable parental consent, we will delete it and terminate the associated account promptly.

9. State Privacy Rights (U.S.)

If you live in California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Tennessee, Iowa, Delaware, Florida, Indiana, New Hampshire, New Jersey, or another state with a comprehensive privacy law, you have the rights listed in Section 7 above, including the right to opt out of the "sale" or "sharing" of personal information and of processing for targeted advertising or profiling. We do not sell personal information, share it for cross-context behavioral advertising, or use it for profiling with legal or similarly significant effects.

California residents may also request the categories of personal information we have collected and disclosed for a business purpose in the preceding 12 months; both categories are described in Sections 2 and 6 of this Policy.

10. International Users

Peak Training is operated from the United States. If you access the Service from outside the United States, your information will be transferred to and processed in the United States. If you are in the EEA, UK, or Switzerland, we rely on appropriate safeguards (such as Standard Contractual Clauses) for cross-border transfers and provide the rights required by applicable law.

11. Cookies and Similar Technologies

We use a minimal set of first-party cookies and local storage to keep you signed in, remember your preferences, and measure aggregate usage. We do not use third-party advertising cookies. You can control cookies through your browser; disabling them may affect functionality.

12. Changes to This Policy

We may update this Policy from time to time. When we make material changes, we will notify you by email or through the Service and update the "Effective" date above. We will ask you to re-accept the Policy when changes materially affect your rights.
